Terms of Service

1. Acceptance of Terms

By downloading, accessing, or using the FerryPass mobile application ("App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App.

2. Description of Service

FerryPass is a cross-business loyalty network that allows users to earn and redeem points at participating merchants on Staten Island, New York. Points are earned by making purchases at partner merchants and scanning the merchant's QR code.

3. Account Registration

You must create an account to use FerryPass. You are responsible for maintaining the confidentiality of your account. You agree to provide accurate information and to update it as needed.

4. Points and Rewards

• Points are earned based on purchase amounts at participating merchants.
• Points have no cash value and cannot be exchanged for cash.
• Points may expire if your account is inactive for 12 consecutive months.
• We reserve the right to adjust point balances in cases of fraud, error, or system malfunction.
• Redemption of points requires a minimum purchase amount as displayed in the app.
• Redemption codes expire 5 minutes after generation.
• We reserve the right to modify point values, earning rates, and redemption thresholds at any time with reasonable notice.

5. User Conduct

You agree not to:

• Create multiple accounts to exploit referral or point bonuses
• Scan QR codes without making a legitimate purchase
• Use automated tools to interact with the App
• Attempt to manipulate point balances or transaction records
• Share redemption codes with others
• Reverse-engineer, decompile, or modify the App

Violation of these terms may result in account suspension or termination and forfeiture of all accumulated points.

6. Merchant Participation

• Merchants participate in FerryPass voluntarily and may join or leave the network at any time.
• We do not guarantee the availability, quality, or pricing of goods or services at participating merchants.
• Disputes regarding purchases should be resolved directly with the merchant.

7. Referral Program

• Users may refer friends using their unique referral code.
• Both the referrer and the new user receive 100 bonus points when the new user completes their first qualifying transaction.
• Abuse of the referral program (self-referral, fake accounts) will result in forfeiture of referral points and possible account termination.

8. Intellectual Property

The FerryPass name, logo, and app design are the property of White Lighter Club Studios LLC. You may not use our trademarks without written permission.

9. Disclaimer of Warranties

FerryPass is provided "as is" without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

10. Limitation of Liability

To the maximum extent permitted by law, FerryPass and its operators shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to loss of points, data, or business opportunities.

11. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination, all accumulated points are forfeited.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes are posted constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles.

14. Disclaimer

FerryPass is not affiliated with, endorsed by, or connected to the New York City Department of Transportation (NYC DOT) or the Staten Island Ferry service. The name "FerryPass" refers to the cultural connection Staten Islanders share through the ferry experience and does not imply any official partnership.
